This report, concerning the privacy policies regarding personal data by NIKAIA MOTORSPORT S.S.D. Usage Data: this refers to information collected automatically by this Application (or by third-party applications that this Application uses), including: the IP addresses or domain names of the computers used by the user who connects with this application, the addresses in URI (Uniform Resource Identifier) notation, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the status of the server's response (successful, error, etc.), the country of origin, the characteristics of the browser and operating system used by the visitor, the various time details of the visit (for example, the time spent on each page), and details regarding the path followed within the application, with particular reference to the sequence of pages viewed, parameters related to the user's operating system, and the user's IT environment.
Profiling: any form of automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning the professional performance, economic situation, health, personal preferences, interests, reliability, behavior, location or movements of said natural person
User: the individual who uses this application, who must coincide with the Data Subject or be authorized by the latter and whose personal data may be subject to processing.
Processing: any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of making available, alignment or combination, restriction, erasure or destruction
Data Controller (or Controller): the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
Data processor: the natural or legal person, public authority, agency or other body which processes personal data on behalf of the data controller;
This Application or Platform: the hardware or software tool through which users' personal data is collected.
Data Protection Officer (also DPO): a mandatory figure in certain cases provided for in Article 37 of the Regulation. Carries out consulting, monitoring, coordination, and management of relations with the Supervisory Authority regarding the processing of personal data.
THE "DATA CONTROLLER"
The "Data Controller" of your personal data that may be processed as a result of the use of this website, pursuant to art. 26 of Regulation (EU) 679/2016, is NIKAIA MOTORSPORT S.S.D. A R.L. – Via Caprera 1 – 37120 – Verona (VR) – IT.
PURPOSE AND LAWFULNESS OF DATA PROCESSING
The personal data provided by users who access this site, and possibly use the "CONTACTS" service, will voluntarily provide the following information:
• “CONTACTS”: service provided to Users interested in receiving information regarding the services offered by the Data Controller in the field of personal data protection. The personal data required to access this service are exclusively the following: Name, Surname, and E-Mail of the user.
The user data resulting from the service provided are used solely for the purpose of carrying out the service itself or the requested performance, and will not be disclosed to third parties. The Data Controller has determined the purposes of the processing identified in the performance of the Controller's own activities.
LEGAL BASIS OF PROCESSING
The data subject, by using the "CONTACTS" service, gives consent to the processing of their personal data for the purposes described above pursuant to Article 6, paragraph 1, letter a) of Regulation (EU) 679/2016.
LEGITIMATE INTERESTS PURSUED BY THE DATA CONTROLLER
At the same time, the Data Controller, for Direct Marketing purposes, pursues its own legitimate interests pursuant to Article 6, paragraph 1 letter f) of Regulation (EU) 679/2016.
DISCLOSURE AND RECIPIENTS OF PERSONAL DATA
Communication will take place only and exclusively with employees and direct collaborators of the Data Controller for the sole purpose of carrying out the service possibly requested by the user, unless communication is required by legal obligations.
The optional, explicit and voluntary sending of emails to the addresses indicated on the site entails, by its very nature, the subsequent acquisition of the sender's address, which is necessary to respond to requests, as well as any other personal data included in the message.
We invite our users, when requesting services or submitting questions, not to send names or other personal data of third parties that are not strictly necessary, or data defined as "sensitive and/or special" pursuant to Articles 9 and 10 of Regulation (EU) 679/2016, within the limits and for the purposes specified in this notice.
METHODS AND MEANS OF PROCESSING
Personal data is processed using automated tools, for the time necessary to achieve the purposes for which it was collected.
Specific security measures are observed to prevent data loss, unlawful or improper use, and unauthorized access in compliance with the obligations to adopt adequate security measures. All data, in fact, will be acquired and stored in accordance with Articles 32, 33 and following of EU Regulation 679/2016.
The Owner is not responsible for errors, content, cookies, publication of immoral or illegal content, advertising, banners or files that do not comply with current regulations by sites not managed by the Owner.
TRANSFER OF DATA TO A THIRD COUNTRY
No data transfer to a third country is envisaged.
AUTOMATED DECISION-MAKING PROCESS
There is no automated decision-making process.
DURATION OF THE TREATMENT
The personal data acquired, including through the "CONTACTS" service, will be stored for the duration necessary to carry out the activities requested by the User and in any case for no longer than 2 years from the time of entry.
The retention period may be extended and involve the acquisition of additional data subsequently, in the event that the user requests further services; in this case, the duration of processing, for administrative, accounting, tax, and contractual purposes, may be extended up to 10 years after the termination of the relationship, as provided for by current regulations (art. 2220 of the Civil Code, art. 22 of the Presidential Decree of 29/09/1973 no. 600, and art. 2200 of the Civil Code).
The technical navigation cookies (described below) will be stored solely to allow the correct technical functioning of the site itself and will automatically expire when the browser is closed.
TYPES OF BROWSING DATA PROCESSED
The computer systems and software procedures responsible for the operation of this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.
These are pieces of information that are not collected to be associated with identified data subjects, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.
This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the addresses in URL (Uniform Resource Locator) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the user's operating system and IT environment.
This data is used solely for the purpose of obtaining anonymous statistical information about the use of the site and to check its correct functioning, and is deleted immediately after processing.
The data in question may be used to ascertain responsibility in the event of any computer crimes against our site.
RIGHTS OF THE DATA SUBJECTS
The subjects to whom the personal data refer, pursuant to Article 13 of EU Regulation 679/2016, have the right at any time to obtain confirmation of the existence or otherwise of such data and to know their content and origin, verify their accuracy or request their integration, updating, or rectification. The subjects to whom the personal data refer also have the right to request the deletion, transmission of the data to other controllers, transformation into anonymous form or blocking of data processed in violation of the law, as well as to object in any case, for legitimate reasons, to their processing. Data subjects also have the right to lodge a complaint with the supervisory authority (Privacy Guarantor).

Information to be provided when personal data is collected from the data subject
1. In the event of data collection from the data subject concerning them, the data controller shall provide the data subject, at the time the personal data are obtained, with the following information:
a) the identity and contact details of the data controller and, where applicable, of their representative;
b) the contact details of the data protection officer, where applicable;
c) the purposes of the processing for which the personal data are intended as well as the legal basis for the processing;
d) where the processing is based on Article 6, paragraph 1, letter f), the legitimate interests pursued by the data controller or by third parties;
e) any recipients or categories of recipients of the personal data;
f) where applicable, the intention of the data controller to transfer personal data to a third country or to an international organization and the existence or absence of an adequacy decision by the Commission or, in the case of transfers referred to in Article 46 or 47, or Article 49, second paragraph, reference to the appropriate or suitable safeguards and the means to obtain a copy of such data or where they have been made available.
2. In addition to the information referred to in paragraph 1, at the time the personal data is obtained, the data controller provides the data subject with the following additional information necessary to ensure fair and transparent processing:
a) the retention period of personal data or, if not possible, the criteria used to determine that period;
b) the existence of the data subject's right to request from the data controller access to personal data and the rectification or erasure of such data or the restriction of processing concerning them or to object to their processing, as well as the right to data portability;
c) where the processing is based on Article 6(1)(a) or Article 9(2)(a), the existence of the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal;
d) the right to lodge a complaint with a supervisory authority;
e) whether the communication of personal data is a legal or contractual obligation or a requirement necessary for the conclusion of a contract, and whether the data subject is obliged to provide the personal data as well as the possible consequences of failure to provide such data;
f) the existence of automated decision-making, including profiling referred to in Article 22, paragraphs 1 and 4, and, at least in such cases, meaningful information about the logic used, as well as the significance and the expected consequences of such processing for the data subject.
3. If the data controller intends to further process the personal data for a purpose other than that for which they were collected, before such further processing, they shall provide the data subject with information regarding that different purpose and any further relevant information referred to in paragraph 2.
4. Paragraphs 1, 2 and 3 do not apply if and to the extent that the data subject already has the information.

Some of these services operate through servers located in different geographic locations, making it difficult to determine the exact location where Personal Data is stored.
